Terms of Service

These Terms of Service are entered into by and between You and How Are You Mom, LLC ("HAYM" or "Company"). The following terms and conditions govern Your use and access to howareyoumom.com and its affiliated subdomains (the "Site"), all our software, products, applications, email notifications, and text notifications (collectively, the "Services").

By accessing and using the Services, You acknowledge that You have read, understood, and agree to be bound by this Agreement. The Services are offered to participants who are 18 years of age or older. If You do not wish to be bound by these Terms, please exit the Services now.

Permitted Uses

The Services include educational and supportive virtual programming designed for individuals caring or planning for the needs of aging parents and older family members. Services are delivered primarily through live online sessions, supplemented by webcasts, online materials, and messaging tools.

Conduct

You agree not to use the Services to:

  • Transmit content that is unlawful, threatening, abusive, harassing, defamatory, or hateful
  • Harm minors in any way
  • Impersonate any person or entity
  • Upload content that infringes any intellectual property rights
  • Transmit spam, chain letters, or unauthorized advertising
  • Upload viruses or malicious code
  • Interfere with or disrupt the Services
  • Use automated means (including AI) to scrape or extract data
  • Modify, copy, sell, or create derivative works of the Services

Subscription & Billing

HAYM offers services on a monthly subscription basis. The initial subscription charge is billed immediately upon sign-up, prior to attendance of the first class. Subsequent monthly charges will be processed seven (7) business days following the prior month's scheduled class date.

By enrolling, you authorize us to charge the payment method on file on a recurring basis. The Subscription automatically renews at the end of each billing cycle unless canceled.

Cancellations: You may cancel Your Subscription at any time through your dashboard. Cancellations take effect at the end of the current billing cycle. Fees are non-refundable once billed.

Payment Processing

We use Stripe, Inc. as our third-party payment processor. By submitting payment information, You grant us the right to provide information to Stripe subject to our Privacy Notice.

You represent and warrant that such payment information is true and that You are authorized to use the payment instrument. You will promptly update Your account information with any changes.

Educational Nature of Services

No Professional Advice: The Services are intended solely to be educational and informational. We are not licensed therapists, counselors, psychologists, or medical providers. Nothing provided through the Services constitutes medical advice, diagnosis, treatment, or mental health care.

You should always seek the advice of qualified professionals regarding any medical, mental health, legal, or financial concerns.

Facilitator Role: Sessions are moderated by a facilitator whose role is to guide discussion, share general educational information, and encourage peer dialogue. The facilitator does not provide individualized advice or professional recommendations.

Participant Responsibility: Statements, opinions, or experiences shared by other participants are their own. Participation and sharing are entirely voluntary, and You are encouraged to share only what You are comfortable disclosing.

Recording of Sessions

Live sessions may be recorded for quality, educational, and content development purposes.

Recordings are processed through an anonymization service to remove personally identifiable information. Anonymized content may be analyzed using third-party AI tools to generate summaries, insights, and educational materials.

Anonymized excerpts, summaries, or themes may be used for:

  • Educational materials
  • Blog posts
  • Social media content
  • Weekly digests distributed to participants

No personally identifiable information will be included in such materials.

Registration & Privacy

To access some Services, You may be required to complete our online registration form. You are responsible for maintaining and updating Your Registration Data and ensuring all information is true and accurate.

You agree to:

  • Notify us immediately of any unauthorized access to Your account
  • Ensure You log out at the end of each session
  • Use caution when accessing from public or shared computers

Excessive Cancellations

To maintain program integrity and availability for all participants, if You cancel or reschedule two (2) or more classes within any rolling twelve (12) month period, we reserve the right to terminate or suspend Your access to the Services.

In the event of termination for excessive cancellations, no refunds will be issued for fees already paid.

Intellectual Property

The Site and Services, including all content, materials, software, workflows, session formats, methodologies, text, graphics, audio, video, summaries, and educational materials are owned by or licensed to HAYM and protected by U.S. and international intellectual property laws.

Participant Contributions: By submitting content through the Services, You grant HAYM a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, anonymize, and distribute such content for operating and promoting the Services.

Group sessions involve multiple participants and HAYM cannot guarantee confidentiality of information shared with other participants. You are encouraged to share only information you are comfortable disclosing.

No Resale: You agree not to copy, sell, resell, rent, sublicense, redistribute, or create derivative works of any portion of the Services.

Links to Third-Party Sites

The Services may provide links to other websites or resources provided by third parties. These links are provided for Your convenience only. We have no control over the contents of those sites and accept no responsibility for them or for any loss or damage that may arise from Your use of them.

Modifications & Termination

Modifications: HAYM reserves the right to modify these Terms at any time. We will notify You of material changes by email and/or through a notice on the Services. Your continued use after changes constitutes acceptance.

Termination: HAYM may deny access to the Services at any time for violation of these Terms or for any other reason in our sole discretion. Upon termination, Your right to use the Services immediately ceases.

Disclaimer of Warranties

Limitation of Liability

Indemnification

You agree to defend, indemnify, and hold HAYM harmless from any claims, losses, liability, costs, and expenses (including attorneys' fees) arising from Your violation of these Terms, applicable laws, or any third-party's rights.

General Information

Governing Law: These Terms shall be governed by the laws of the State of New York without regard to conflict of law provisions.

Jurisdiction: You agree to submit to the personal and exclusive jurisdiction of the courts located within New York County, New York.

Claims Deadline: Any claim or cause of action arising out of these Terms must be filed within sixty (60) calendar days after such claim arose or be forever barred.

Entire Agreement: These Terms constitute the entire agreement between You and HAYM regarding the Services.
